A Massachusetts driver who caused a fatal head-on collision with a state trooper had consumed nine alcoholic drinks over three hours before the crash, according to a newly released report from the Essex County District Attorney. Hernan Marrero, 50, of Roslindale, was driving the wrong way on Route 1 in Lynnfield when his Jeep Wrangler struck the cruiser of Trooper Kevin Trainor, 30, around 2:04 a.m. on May 6. Both men died in the crash.
Marrero’s blood alcohol concentration (BAC) was 0.192, more than twice the legal limit, the report states. Investigators found he was served nine drinks at Tribu Mexican Kitchen and Bar in Saugus between 9:20 p.m. and 12:53 a.m. He had also consumed one complimentary drink earlier at a Waltham restaurant.
The Massachusetts Alcoholic Beverages Control Commission (ABCC) issued a notice to Tribu alleging multiple civil violations, including serving alcohol after hours and providing free drinks. A hearing is scheduled for July 28. The DA’s office determined that criminal charges against the bar are "not sustainable."
Surveillance footage reviewed by investigators showed Marrero’s Jeep entering a jughandle, grazing a guardrail, running a red light, and making an improper left turn before driving southbound in the northbound lane. A truck driver called 911 after passing the wrong-way vehicle at 2:02 a.m. Trainor had just completed a public safety detail in the area.
