Lawrence, Massachusetts Mayor Brian DePeña, 61, was arrested Friday on charges of wire fraud and money laundering after an investigation alleged he misused over $1.5 million in COVID-19 pandemic relief funds. The U.S. Department of Justice (DOJ) stated DePeña is accused of diverting funds from Economic Injury Disaster Loans (EIDL) to pay personal taxes, fund his campaign account, and settle high-interest mortgages.
During a viral video clip, DePeña’s lawyer told reporters, “He doesn’t speak English. No comment.” DePeña, who was smiling, repeatedly responded to questions with “God bless you.” The exchange, captured by multiple outlets, has since sparked widespread discussion on social media and among political commentators.
Initial Court Appearance Scheduled
DePeña is set to make his initial court appearance in Boston federal court on Friday. The DOJ alleges he applied for EIDL loans in 2020 and 2021 for Tenares Tire Services Inc., a Lawrence-based business he owned, but used the funds for unauthorized purposes. The EIDL program, administered by the U.S. Small Business Administration (SBA), was designed to assist businesses impacted by the pandemic.
Alleged Misuse of Funds
According to the DOJ, DePeña used the loan proceeds to:
- Pay off over $880,000 in high-interest mortgages.
- Fund his campaign account.
- Cover personal taxes.
The DOJ’s statement emphasized that working capital from EIDL loans was not intended for campaign financing, tax payments, or mortgage settlements. U.S. Attorney Leah Foley stated, “Mayor [DePeña] was elected to be a leader for the City of Lawrence. He was looked up to and trusted by his constituents, but he betrayed that trust through his alleged corruption and lies.”
Law Enforcement Response
The arrest was conducted by federal authorities, with IRS Criminal Investigation (CI) Special Agent in Charge Thomas Demeo noting, “Today’s arrest highlights our continued commitment to safeguarding emergency relief programs and holding accountable those who abuse them.”
Social Media Reaction
A video of the lawyer’s response to reporters’ questions spread rapidly on social media platforms, with some users questioning why DePeña did not speak English. Conservative commentators and influencers criticized the situation, with posts on X (formerly Twitter) highlighting the exchange. One post by LibsofTikTok stated, “OMG. How is this real.” Another by conservative radio host Mike Gallagher read, “‘He doesn’t speak English, no comment’ says the assistant of the mayor of an American city. Our melting pot has completely melted.”
DePeña’s Background and Office Response
DePeña, a Democrat, has served as mayor of Lawrence since his election. His office has not responded to multiple requests for comment from media outlets. Shortly after the video clip circulated, reports indicated DePeña’s vehicle was involved in a minor collision while attempting to drive away from the scene.
The case raises questions about oversight of pandemic relief funds and the expectations for public officials in communicating with constituents and the press.
