Massachusetts Judge William Sullivan on Thursday denied a defense motion seeking a required finding of not guilty in the case of Lindsay Clancy, who is charged with killing her three children in 2023. The ruling clears the way for a potential retrial following a mistrial declared last month.
Sullivan’s decision came after defense attorney Kevin Reddington argued that prosecutors had failed to present sufficient evidence to prove Clancy’s guilt beyond a reasonable doubt. The judge, however, concluded that the prosecution had introduced both physical and circumstantial evidence that could allow a jury to find Clancy responsible for the killings.
In a five-page written order, Sullivan stated: “There was evidence introduced, both physical and circumstantial, that would permit a rational trier of fact to find beyond a reasonable doubt the elements of the charge of murder.”
The defense’s motion did not dispute that Clancy killed her children but instead argued that she was not criminally responsible due to postpartum psychosis, a rare mental health condition. Prosecutors acknowledged Clancy’s history of mental health treatment, including a stay in a psychiatric hospital, but maintained that her actions demonstrated criminal responsibility at the time of the killings.
Clancy, a 36-year-old former labor and delivery nurse, is accused of killing her children in their Plymouth home in January 2023. The case was declared a mistrial on September 4, 2024, after jurors were unable to reach a unanimous verdict. Reddington has consistently argued that the investigation and prosecution’s case were flawed, calling the evidence against his client insufficient.
During a court hearing on Tuesday, Reddington pressed the judge on the lack of direct evidence linking Clancy to the killings, asking: “Where’s the evidence that she did this?” Sullivan did not rule on the motion immediately, deferring further arguments to a November 2 hearing, where additional motions, including a double jeopardy challenge, are expected to be addressed.
The next scheduled court appearance for Clancy is set for November 2, where further legal arguments will be heard ahead of any potential retrial.
