A Los Angeles Superior Court judge granted a temporary restraining order against Halle Berry on Thursday, following allegations by her ex-husband Olivier Martinez that she physically abused their 12-year-old son, Maceo.
The order prohibits Berry from contacting Martinez or their son beyond the terms of their August 2023 split-custody agreement. Visitation with Maceo is now limited to Mondays, Tuesdays, and weekends between 10 a.m. and 8 p.m. The judge also imposed a 100-yard distance requirement between Berry and Martinez.
Berry’s attorney, Marina Beck, called the filing “entirely meritless and deliberately misleading” in a statement. Beck accused Martinez of repeatedly violating court orders and interfering with therapeutic and educational interventions for their son. “Fortunately, Halle is used to this kind of outrageous conduct from Mr. Martinez,” Beck said. Berry’s legal team did not immediately respond to requests for further comment.
Martinez’s attorney, Patrick Baghdaserians, stated that the welfare and safety of Berry and their child remain paramount but declined to comment on Berry’s legal response. The allegations surfaced in court documents reviewed by The Times, which include claims that Berry physically assaulted Maceo on Sept. 26 by jumping on him, putting her hands around his neck, and placing him in a chokehold. Martinez alleged that Berry shouted, “Who is dominant now?!” during the incident.
Court filings cite additional alleged incidents, including a claim that Berry struck Maceo in the face five years ago. Martinez also alleged that Berry had a violent outburst 10 years ago, throwing a plate with a knife and fork, and that during 2023 discussions about child support, she told their son that his father was “a white bitch robbing money from a black woman.”
Berry and Martinez married in France in July 2013 and finalized their divorce in 2016 after a seven-year separation. The couple had previously attended six sessions of co-parenting therapy in an attempt to resolve disputes over raising Maceo. According to court documents obtained by People, the therapy included individual and joint sessions, with Berry’s fiancé, Van Hunt, also participating. A source told People that the couple’s differing parenting styles contributed to ongoing conflicts, though both expressed love for their son.
The temporary restraining order was granted amid a broader custody dispute. In August 2024, Berry sought to compel Martinez’s participation in co-parenting therapy after he requested time off. A judge ruled in her favor in October, noting Martinez had already complied with the request. Berry is currently ordered to pay $8,000 per month in child support for joint custody of Maceo.
