A Los Angeles County Superior Court judge has dissolved a temporary domestic violence restraining order filed by actor Olivier Martinez against his ex-wife, Halle Berry, while maintaining modified visitation terms for their 13-year-old son, Maceo.
Judge Shelley Kaufman ruled Thursday to dissolve Martinez’s temporary restraining order (TRO), citing insufficient evidence to support the protective order request. The decision was made during a closed hearing, according to a minute order reviewed by The Los Angeles Times. The TRO had been granted earlier this month after Martinez accused Berry of physically abusing Maceo.
Visitation terms remain restricted under the court’s prior order. Berry’s scheduled visits with Maceo are limited to Mondays and Tuesdays from 10 a.m. to 8 p.m., as well as every other weekend from Saturday to Sunday during the same hours. Overnight stays with Berry are prohibited, a restriction imposed when the TRO was initially granted. Berry and Martinez had previously agreed to joint physical and legal custody of Maceo in their August 2023 divorce settlement.
Berry’s attorney, Marina Beck, stated in a response to The Times that the ruling was a positive step. “We are extremely pleased that the Court has dissolved the [temporary restraining order],” Beck said. “As we move forward, Halle is determined to continue to focus on the well-being and best interests of her family.”
Martinez’s attorney, Patrick Baghdaserians, told The Times that the decision reflected the judge’s focus on the child’s best interests. “Thursday’s decision was really focused on the best interests of the minor child,” Baghdaserians said, adding that Martinez was “very happy” with the outcome.
Martinez had sought a permanent protective order against Berry, but the judge denied that request. The court’s minute order did not provide additional reasoning beyond stating that Martinez “did not sustain the applicable burden of proof.” Berry has consistently denied the allegations of abuse.
The dispute began after Martinez filed the TRO, leading to a two-week court hearing. The case centers on allegations of physical abuse by Berry against Maceo, which Berry has denied. The court’s decision to dissolve the TRO does not alter the existing visitation restrictions, which were established as part of the ongoing custody arrangement between the parents.
