The murder trial of David Anthony Burke, known professionally as D4vd, was delayed again on Tuesday as prosecutors and defense attorneys continue reviewing 40 terabytes of digital evidence linking him to the murder of 14-year-old Celeste Rivas Hernandez. The preliminary hearing, which will determine whether prosecutors have sufficient evidence to proceed to trial, is now scheduled for June 29 and is expected to last five days.
Burke, 21, has pleaded not guilty to first-degree murder charges. Prosecutors allege he killed and dismembered Hernandez, whose body was found in the trunk of a Tesla linked to Burke. The defense initially pushed for an immediate preliminary hearing but withdrew the request after prosecutors began turning over the extensive digital evidence, including lab reports, photos, video recordings, and forensic evidence.
Prosecutors claim Burke knew Hernandez was underage and continued a sexual relationship with her before her death. They allege he stabbed her to death after she threatened to expose their relationship. According to court filings, Burke then ordered a chainsaw, a burn cage, and a shovel to dismember her remains in his garage. The evidence review is expected to take several months due to the volume of data.
Burke appeared in court shackled and wearing an orange prison suit, remaining silent except to acknowledge the judge’s questions. A status conference hearing is scheduled for June 17 to assess progress in the case.
